Decisions from human rights tribunals, the Ombudsperson, the Teacher Regulation Branch, and the Office of the Information and Privacy Commissioner define how discrimination, procedural fairness, professional conduct, and information rights apply in BC schools. Together, they document systemic patterns and clarify the legal and professional standards school districts must meet.
These decisions strengthen advocacy by providing shared language, persuasive evidence, and precedents that show families’ experiences are not isolated. They can be used to challenge claims that accommodation denials, exclusions, procedural shortcuts, or professional conduct were justified.
This page highlights decisions most relevant to disabled students and complex learners. While not comprehensive, the cases address common issues including IEP failures, exclusion, inappropriate interventions, unfair processes, misconduct, and barriers to accessing records. Links to broader databases support further research.

Teacher Regulation Decisions
Here are some decisions that I think are helpful to parents who have disabled/neurodivergent children. For a list of all of their decisions go to the TRB decision database.
- Teacher was disciplined for laying their hands on a student when it escalated the situation and wasn’t necessary for safety. ** Very relevant to anyone who has had a teacher do this. Tony Schubert
- This teacher was suspended because they didn’t follow the IPE and Safety Plan. Teacher was suspended for not following the IEP and Safety Plan.
- This teacher in the past was disciplined for not following a students safety plan. (See Matter 2)

- Here is another case that is interesting. The student had a “vulnerable learning profile” and she didn’t create a positive learning environment. https://teacherregulation.gov.bc.ca/documents/FormsandPublications/ProfConduct/DisciplineOutcomes/FRASER_CRA_20230626.pdf
- This is another example to take into consideration when you file for emotional safety, diversity or lack of inclusion. This example was a conflict of Teacher Standards #1. https://teacherregulation.gov.bc.ca/documents/FormsandPublications/ProfConduct/DisciplineOutcomes/RUSSELL_CRA_20240624.pdf
- Here is an example of an LSS teacher, not updating a students IEP and forcing them to stay in at recess causing a physical injury. https://teacherregulation.gov.bc.ca/documents/FormsandPublications/ProfConduct/DisciplineOutcomes/SCHWARZ_CRA_20240925.pdf
- This one is about aprincipal thinking its a good idea to duct tape a child to a chair to help them focus on their work. Renee MacCormack
